Brings out the difference between single- and double-action:  single-action there are two decision points,  double-action there's only the one (which can be aborted in progress, but that can't be depended upon).

"[P]laintiff" turns the story around, compared to the "Rust" case:  assuming the person cocking and tickling was the plaintiff, this is a defense attorney pointing out that the plaintiff's lawsuit against the firearm's manufacturer is unsound.

Good edit.  In addition to clarifying, it makes the useful point that the gun just doesn't care.

...

(If they ever make one that does, you'll be able to identify it because I'll be standing over it pounding it to bits with a very large hammer.  You think AI is bad when it's just drawing dumb pictures and telling phony stories!)

I really like the use of “indifferent”. It makes this about the single action. This way I’m not looking for the real hidden story and get the opportunity to consider the firearm itself. You also get across the feeling of an inexperienced or fearful shooter pulling the hammer. The amount of force needed to cock a hammer is so much greater than the force to let it drop that the use of “tickle” is perfect.
